if it's a car dealer in trade or commerce then the consumer laws come into play. If the car is advertised as an 'S' and it is not an 'S' the alleged offence of misleading and disruptive conduct may arise. I don't think knowledge or intention is a requirement to satisfy the legal test. Mark, love the picture, takes me back to the 80's.Paul

This particular yard specialises in older but high end cars, so there are lots of Porsches, Mercs, BMW's, which all deserve specialist knowledge. This yard also carries a lot of stock on consignment. Because the salesmen don't know any better, they just repeat what they were told. The salesman I spoke to had no idea that the identity of a Porsche could be determined from the VIN. He was not being shady, just uninformed.
I am not in any defending this sort of business behaviour, but in reality, anyone about to spend $40,000 on a Porsche, should at least know what the fifth digit on the VIN means.
